1. Acceptance of Terms

By accessing and using Donation Fatigue™ ("the Platform"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Platform.

2. Description of Service

Donation Fatigue™ is a platform that connects donors with verified charitable organizations. We provide:

• A matching system between donors and organizations based on preferences
• Tools for donors to manage their giving profiles and track impact
• A platform for organizations to showcase their work and receive donations
• Payment processing facilitation through third-party providers

3. User Accounts

For Donors:

• Creating an account is free
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate and current information
• You may delete your account at any time

For Organizations:

• Organizations pay an annual subscription fee of $99/year
• All organizations must provide valid tax-exempt documentation
• Organizations must maintain current and accurate information
• We reserve the right to verify all submitted information
• Approval is at our sole discretion

4. Donations and Payment Processing

• Direct Donations: 100% of donations go directly to the selected organization. Donation Fatigue™ does not charge any transaction fees on donations.
• Payment Processing: All donation payments are processed through Stripe. Organizations must set up their own Stripe accounts to receive donations.
• Tax Receipts: Organizations are responsible for providing tax-deductible receipts to donors.
• Refunds: All refund requests must be directed to the receiving organization.
• No Guarantees: We do not guarantee any specific donation amounts or donor matching.

5. Organization Verification

While we make reasonable efforts to verify organizations, we do not guarantee the accuracy of all information provided by organizations. Donors should conduct their own due diligence before making donations. The "verified" badge indicates we have reviewed tax-exempt documentation and basic organizational information.

6. Prohibited Activities

You agree not to:

• Provide false or misleading information
• Impersonate any person or entity
• Use the Platform for any illegal purposes
• Attempt to gain unauthorized access to any part of the Platform
• Interfere with the proper functioning of the Platform
• Use automated systems to access the Platform without permission

7. Intellectual Property

The Platform and its original content, features, and functionality are owned by Donation Fatigue™ and are protected by international copyright, trademark, and other intellectual property laws.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DONATION FATIGUE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

10. Indemnification

You agree to indemnify and hold harmless Donation Fatigue™ from any claims, damages, losses, liabilities, and expenses arising out of your use of the Platform or violation of these Terms.

11. Termination

We reserve the right to terminate or suspend your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Platform. Your continued use of the Platform after such modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
